CONCERNING
STIPULATION OF THE EXPORT REFERENCE PRICES (HPE) OF CERTAIN EXPORT GOODS
THE MINISTER OF TRADE OF THE REPBULIC OF INDONESIA,
Attachment
Considering:
- 1. That in order to implement the provision in article 3 paragraph (6) of government regulation No. 35/2005 regarding export levies on certain exported goods, it is necessary to stipulate a regulation of the Minister of Trade on stipulation of certain exported goods;
- 2. That in relation thereto, it is necessary to issue a regulation of the Minister of Trade;
in view of:
- 1. Trade ordinance of 1934 (statute book of 1938 No. 86);
- 2. Law No. 10/1995 on customs affairs (statute book of 1995 No. 75, supplement to statute book No. 3612) as has already been amended by the Law No. 17/2006 )statute book of 2006 No. 93, as supplement to statute book No. 4661);
- 3. Law No. 20/1997 on non tax state revenue 9statute book of 1999 No. 30, supplement to statute book No. 3888);
- 4. Government regulation No. 35/2005 on export levies on certain exported goods (statute book of 2005 No. 82, supplement to statute book No. 4531);
- 5. Presidential decree No. 260/1967 on affirmation of the task and responsibility of the Minister of Trade in the foreign trade sector;
- 6. Presidential decree No. 187/M/2004 on establishment of United Indonesia cabinet as has already been amended by presidential decree No. 8/M/2005;
- 7. Presidential regulation No. 9/2005 on the status, tasks, functions, organizational structures and working arrangements of state ministries;
- 8. Presidential regulation No. 10/2005 on first-echelon organizational units and tasks of state ministries, as has already been amended several times and the latest by presidential regulation No. 15/2005;
- 9. Decree of the minister of industry and trade No. 558/MPP/KEP/12/1998 jo by regulation of the Minister of Trade No. 01/M-DAG/PER/1/2007 on general export provisions;
- 10. Regulation of the Minister of Trade No. 01/M-DAG/PER/3/2005 on the organizational and working arrangement of the ministry of trade as has already been amended several times and the latest by regulation of the Minister of Trade No. 22/M-DAG/PER/5/2007;
- 11. Regulation of the Minister of Trade No. 25/M-DAG/PER/12/2005 on procedures for stipulation of export check prices of certain exported goods;
- 12. Regulation of the Minister of Trade No. 59/M-DAG/PER/3/2006 dated march 29,2006 on the establishment of the team for stipulating export check prices (HPE) of certain exported goods;
Observing:
- 1. Result of the coordinating meeting with related institutions and associations on September 20 and 21, 2007 regarding stipulation of HPE of palm nut, CPO and derivative products and wood, rattan as well as skin in October 2007.
- 2. Letter of the director general of Agricultural product processing and marketing No. 706/PP.220/G/9/2007 dated September 25,2007 on prices of palm nut and derivative products in the August-September 2007 period as input to HPE in October 2007.
HAS DECIDED:
To stipulate:
REGULATION OF THE MINISTER OF TRADE ON STIPULATION OF EXPORT CHECK PRICES (HPE) OF CERTAIN EXPORTED GOODS
Article 1
The Minister in charge of trading affairs or the appointed official, in this case the Director General of Foreign Trade would stipulate export check prices (HPE) of certain exported goods every month.
Article 2
HPE as intended in Article 1 would be stipulated by referring to international average prices and/or FOB average prices at seaports in Indonesia in one month before the stipulation of HPE.
Article 3
(1) The rate of export levy on palm oil and its derivative products shall refer to the average price of CPO CIF Rotterdam within one month before HPE is stipulated.
(2) The average price as intended in paragraph (1) shall be US$830/MT.
(3) Based on the average price as intended in paragraph (2) the rate of export levy shall be as contained in attachment IV to regulation of the minister of finance No. 94/PMK.011/2007 date August 31,2007 regarding the seventh amendment to regulation of the Minister of Finance No. 92/PMK.02/2005 dated October 10.2005 on stipulation of export check prices of certain exported goods and rate of export levy.
(4) The amount of HPE, Export levy and value of export levy on Palm oil, CPO and its derivative products shall be stipulated as contained in Attachment I to this regulation.
Article 4
HPE, Export Levy and value of export levy on timber, rattan and leather shall be stipulated as contained in attachment II to this regulation.
Article 5
HPE as intended in Articles 3 and 4 shall apply as from October 1,2007 to October 31, 2007.
Article 6
In the case of the validity period of HPE stipulated on the basis of this regulation which had already expired and new HPE is yet to be stipulated, HPE as contained in the Attachment I and II to this regulation shall remain effective as the basis for calculating PE until new export prices are stipulated.
Article 7
With this enforcement of this regulation, the export check prices (HPE) as contained in the attachment to regulation of the Minister of Trade No. 35/M-DAG/PER/8/2007 on stipulation of export check prices (HPE) of certain exported goods shall be declared null and void.
For public cognizance, the regulation shall be published by placing it in state gazette of the Republic of Indonesia.
